Energy requirements are contained in the Virginia Construction Code and residential provisions, generally based on the 2021 IECC with state-specific modifications. Because the USBC is uniform statewide, localities cannot create weaker technical building standards, but they do administer permits, inspections, and local zoning separately.
Permit Process
Building permits in Virginia are issued by the local city, county, or town building department, not directly by the state for ordinary construction. The typical workflow includes zoning approval, permit application, plan submission, plan review, fee payment, permit issuance, required inspections, corrections if needed, and final approval or certificate of occupancy. Many Virginia jurisdictions offer online portals for residential additions, decks, trade permits, and commercial plan review.
Engineering Requirements
Professional engineers in Virginia are licensed by the Department of Professional and Occupational Regulation through the APELSCIDLA Board. Engineer-sealed drawings are commonly required for commercial construction, structural alterations, unusual foundations, retaining walls, large decks, engineered roof or floor systems, and designs outside prescriptive IRC limits. Wind, snow, flood, and soil conditions must be addressed using the applicable USBC provisions and referenced standards such as ASCE 7.
Local Licensing
Virginia contractors are regulated by the Virginia Board for Contractors under DPOR, with Class A, B, and C licenses based on project size and annual volume. Many trades, including electrical, plumbing, HVAC, and gas fitting, require appropriate specialty licenses or certified tradespeople. Local jurisdictions may also require a business license or local registration before issuing permits, even when the contractor holds a state license.
Residential Permits
Residential permits are generally required in Virginia for new homes, additions, structural alterations, decks, porches, finished basements, garages, swimming pools, major electrical work, plumbing changes, HVAC replacements, and changes of occupancy. Minor cosmetic work such as painting, flooring, cabinets, and similar nonstructural finishes usually does not require a building permit, although zoning or historic district approval may still apply. Detached accessory structures may be exempt below certain size thresholds, but local zoning setbacks and floodplain rules can still control placement.
Commercial Permits
Commercial projects in Virginia typically require more detailed plan review than residential work, including code analysis for occupancy classification, construction type, fire-resistance ratings, accessibility, egress, energy compliance, and fire protection systems. Tenant improvements, restaurants, offices, warehouses, medical spaces, and change-of-use projects often require architectural or engineering plans and separate trade permits. A certificate of occupancy or new certificate of use is commonly required before a new commercial space can open to the public.
County Differences
Virginia’s technical building code is statewide, but permit procedures vary significantly among counties, cities, and towns. Larger jurisdictions such as Fairfax County, Loudoun County, Arlington, Richmond, and Virginia Beach often have formal electronic plan review, zoning intake, and separate trade permit workflows. Rural localities may have simpler submittal requirements but can have longer inspection travel windows, private well and septic coordination, or floodplain review requirements.
Climate Considerations
Virginia projects must account for coastal wind exposure in Tidewater and the Eastern Shore, mountain snow loads in western counties, expansive or variable soils, and floodplain requirements along rivers and coastal areas. Seismic design is generally moderate but still addressed through the USBC and ASCE 7 risk categories and mapped ground motion values. Coastal communities may require elevated construction, V-zone detailing, breakaway walls, flood-resistant materials, or additional documentation under FEMA-based local floodplain ordinances.
Permit Timelines
Simple residential trade permits in Virginia may be issued same day or within a few business days when submitted through an online system. Residential additions, decks, garages, and basement finishes commonly take one to three weeks for review, while complex commercial projects can take several weeks or longer depending on completeness and agency coordination. Timelines are affected by zoning approvals, health department review, fire marshal review, floodplain review, resubmittals, and local workload.
